Scope and Content Note

The Suffolk County Court records are a collection of materials from legal cases in the nineteenth century. This collection has been divided into two series.


Series I. Depositions contains depositions and testimonies from individuals regarding specific events on individual ships. There is some material in this series other than depositions and testimonies, such as bills and insurance papers; however, the majority of this series contains depositions and testimonies. This series has been organized by ship name.


Series II. Other Court Papers contains other materials from various court cases. These materials include depositions and testimonies, insurance papers, correspondence, bills and invoices. Also included in this series are receipts for tows for the sloop Shawmut, and some miscellaneous papers.


Historical Sketch

Suffolk County Court was established as one of the inferior quarterly courts by the Great and General Court of the Bay Colony, sometime in 1635-1636. Located in Boston, its criminal jurisdiction was the equivalent to the quarter sessions in England. This included appointing commissioners to hear small cases, trustees of public legacies, people to build highways, a master of the house of correction, searchers of money, and viewers of fish. The court was also responsible for: confirming the nomination of military officers, apportioning charges for the repair of bridges, licensing innkeepers and packers of sturgeon, punishing license violations, ordering the removal of obstructions on highways, punishing idle persons, punishing excess of apparel, compelling the restitution of overcharging by merchants, determining the rates of wages in cases of disputes, providing for the poor, admitting freemen who were church members, fixing ministers' allowances and insuring that they were paid, inquiring in to the publication of heretical doctrines, punishing heretics and profaners of the Sabbath, ensuring that Native Americans were civilized and receiving religious instruction, all varieties of probate business, and punishing those who carried on unlicensed trade with the Native Americans.
